    AVERIT (AVERA), HENRY, SR. - 3 JULY, 1772 - TRANSCRIPT OF ACTUAL WILL

    IN THE NAME OF GOD AMEN. I Henry Averit of the County of Bertie in the province of North Carolina being and
    aflected with bodely pain but of perfect sence, sound mind and memory do make and ordain this my last will and
    Testament in manner and form following.

    (The promises) I give and bequeath unto my grandson Jessee Averet son of my son Henry Averet his heirs and
    assigns forever my dwelling plantation and adjoining land.

    Whereas

    Item - I give and bequeth unto my said grandson Jessee Averet his heirs and assigns forever one Negro boy
    Tom.

    Item - I give and bequeth unto my grandaughter Elizabeth Averet daughter of my son Henry Averet her heirs
    and assigns forever one Negro boy Soloman.

    Item - I give and bequeth unto my son Charles Averet his heirs and assigns forever one lot of land lying in
    Windsor at or near the landing.

    Item - I give and bequeth unto my said son Charles Averet his heirs and assigns forever the following Negroes,
    Wallis, Nan, Frank, Dick and for future increases.

    Item - I give and bequeth unto my grandson James Abington, son of my daughter, Sary Abington his heirs and
    assigns forever the following Negroes, Peter and Easter.

    Item - I give and bequeth unto my grandson Hardayman Abington his heirs and assigns forever one lot of land
    lying in Windsor.

    Item - I give and bequeth unto my aforesaid grandson Hardayman Abington his heirs and assigns forever on
    Negro boy Harper.

    Item - I give and bequeth unto my daughter Mary Bryan her heirs and assigns forever one parcel of land x?x?x?
    x?x lying in Johnston County near Nuece River.

    Item - I give and bequeth unto my said daughter Mary Bryan her heirs and assigns forever the following
    Negros, Thomas, Bob, Jo, Peter and heirs forever.

    Item - I give and bequeth unto my seven grandchildren, sons and daughters of my daughter Sary Abington,
    named as follows: Mary Abington, Martha Abington, Elizabeth Abington, William Abington, Thomas Abington,
    Henry Abington and Littleburry Abington They or some or all their heirs and assigns forever one Negro woman
    that and ten pounds current money of Virginia to be raised and leved out of my Estate and ato be equally
    divided between them share and share alike.

    Item - I give and bequeth unto my son Charles Averit and my daughter Mary Bryan and unto my daughter Sary
    Abington's children and unto my son Henry Averet children and to all their heirs and assigns forever the
    following articles on Mill worm and Cap, one stock of Cattle at Pampleito, one stock of cattle at Cotharey and
    remainder of any estate that shall be remaining after the Legates and all ;my just debts paid off to be equally
    divided between them as the following manner. My said son Charles Averet to ;have ;one fourth part of the said
    ;Hill stock of cattle and remainder of ther estate and my said daughter Mary Bryan to have one fourth part of the
    above mentioned articles and my daughter Sary Abington's children to have one fourth part amongst them all
    and to be equally divided amongst them share and share alike and my son Henry Averets children to have on
    fourth part amongst them all and to equally divided amongst them all and share and share alike.

    Lastly I nominate, Constiture and appoint my son Charles Averet and Noah x?x?x?x Executors to this my last
    will and testament hereby revoking and disanulling all others heretofore by me made.

    In the name of God amen. I Henry Avaritt of Bertie County, being sick and weak in body, but perfect mind and
    memory, thanks be given unto God. Calling unto mind the mortality of my body and knowing that is appointed
    for all men once to die I do make and ordain this my last will and Testament that is to say once partly and first of
    all I give and recommend my soul into the hand of almighty God that gave it and body I recommend to the earth
    to be buried in decent christian burial at the descretion of my Executors nothing doubting but at the general
    resurrection I shall recover the same again by the mighty power of God and touching such wordly Estate where
    with I have pleased God to bless me in this life I give devise and dispose of the same in the following manner
    and form.

    First I give and bequeath to Millea Avaritt, my dear Beloved wife, one Negro wench named Clowe and on bay
    horse called Jack, also I; give my well beloved son Jessee Avaritt one young horse called pompe, also I give all
    my Negroes except the aforesaid wench to my four children Jessee Avaritt, Seley Avaritt, Martha Avaritt and
    Betty Avaritt for my said Negroes and their increases to be equally divided among my aforesaid children when
    my son Jessee comes ;to the age of ;nineteen years old. Also I give to my daughter Seley Avaritt and my
    daughter Martha Avaritt one piece of land, Missaye (?) and tenament. The said land to be divided in two equal
    parts and my daughter Seley to have on equal part and my daughter Martha to have the other equal part of the
    said piece of land is called Pie Hill.

    Also I ;give and bequeth to my daughter Betty Avaritt forty five poumds Virginia money. The said money to come
    out of the nineth pounds that my father is to give me for Dick, also I leave all my stock of cattle, horses and
    hogs to be equally divided among my wife and four children after my just debts is paid.

    Also I give my household goods and moveables to be equally divided between my wife and four children. I also
    desire and impower my Executors to sell any part of my stock to raise money to pay my just debts and as my
    stock increases my will and desire is that my Executors sell such part of the incresase as they shall think
    proper and put the money to interest for my four children and likewise constitute;, make and ordain my brother
    Charles Avaritt and Thomas Pugh Executors of this my last will and testament and I do ;hereby utterly disallow,
    revoke and dispose all and every other testaments, wills, Legates, Bequests by me any ways before lnamed
    willed and bequeaths ratifying and confirming this and no other to be lmy last ;will and testament unto whereof I
    hereunto set my hand and seal.

    Kershaw & State of South Carolina of the one part and THOMAS AVERA of the other and state aforesaid of the
    other part witnesseth the said William Sheffield for and in consideration of the sum of five hundred dollars to
    me in hand paid by the said THOMAS AVERA at and before the sealing and delivering of these presents, the
    receipt whereof is hereby acknowledged land bargained, sold, released confirmed and by these presents I do
    bargain, sell,release, and confirm unto the said THOMAS AVERA his heirs and assigns forever, a piece of land
    supposed to be twenty acres , more or less, and on the lower end of a hundred acre tract of land & on the East
    side of Little Lynches Creek & bordering the backside by land granted to John Marshall, and on the upper to
    where a dividing line is run, lying and being in the District of Camden and County of Kershaw on South Lynches
    Creek bounded on all sides by vacant lands at the time of survey and hath such shape and marks as a plat
    annexed the originial grant represents, the said land being granted to James Foland by letters, patents,
    bearing date March one thousand seven hundred & seventy three, reference thereunto being had will more
    fully and at large appear, bounded when surveyed on all sides by vacant land as appears by a plat thereof to
    the grant annexed. Together with all and singular the rights, liberties, heriditaments and appurtenances
    whatsoever whereunto belonging. To have and to hold the said land with the appurtenances unto the said
    THOMAS AVERA, his heirs and assigns forever and the said William Sheffield for himself and his heirs and doth
    covenant, promise and agree to and with the said THOMAS AVERA that the rights and titles of the said land
    containing twenty acres more or less all its premises and against all and every person or persons whatsoever
    claiming on that hereafter may claim through from or under him the said William Sheffield, his heirs and assigns
    he or they will warrant and by these presents forever defend against all and every incumberance. In Witnesss
    whereof the said William Sheffield hath hereunto set his hand and seal, the day and date, first above written.

    James Barneycastte made oath and saith that he was present & saw the within named William Sheffield, sign
    seal & as his act and deed deliver the within instrument of writing for the purposes therein expressed and also

    MOVING WEST

    Dr John Avera (Uncle) Fathers oldest brother was a Surgeon in the Confederate Army. His only son Fayette
    volunteered in the Confederate war at the age of 16. Was never heard from since.

    During uncle John's service he saw some and heard of many named Avera who too probably had fled France
    and persecution.

    In later years after the Confederate War he made a trip to some of the Eastern states and met quite a few of
    Avera's whose experiences and dates and hardships FLEEING EUROPE were very much the same as those who
    came in Grand Father's time. However they could trace no near relationship.

    It might interesting if you to look up Noviascotia & French Canadians. While the writer was working at the
    lumber mills in La. and East Texas, the writer knew some skilled Mechanics of French decent, some were
    Methodist but, when they introduced to some oldest settlers from nearer the Gulf Coast they had difficulty
    making their spoken French "Jibe".

    When Grand Father his brothers were moving West, there were others who moving West also. When they
    arrived in Alabama we have date . or how long they stayed., but there we do know that Grand Father met and
    married our Grand Mother , Sue Middleton in Alabama.

    Crossing the Chickasawhay River to the West he built a Ferry, a home, cleared swamp land and raised good
    crops. Put out fruit orchards, Being very industrious it was not many years till he was carrying his live stock,
    eggs, apples, peaches & etc to Mobile, Ala., then the best and nearest market on the Gulf Coast.

    I think we can safely attribute and the others who were with to the unfriendliness of Seminole Indians. While
    the Choctaw Nation in Miss. were friendly to the PALE FACES.

    John W Avera the single brother settled and built and operated the Ferry four miles below home which later
    became known as Adamsville. He was called a great swimmer of that day , but a rise in the river made it difficult
    to operate. When his two Negro men allowed the ferry rope to jerk them overboard. Great Uncle, the powerful
    man that he was, plunged in after them. The first he reached seized uncle for safety. The other Negro floated
    down current a short distance grabbing at brittle willow tops. All three drowned.

    Ownership then passed to a man of means, he too had no descendants. A Marine Engineer by the name Jacob
    McClean was then living in New Orleans was the nearest relation. When advised that he could not long. Mr
    Adams directed that Capt. McLean be notified to come and take charge of his property. Am not sure but think
    the Captain was a nephew.

    Later when the writer was about seven years old brother was detailed to take the oxteam and haul the McLean
    household goods to Adamsville for them. I am not sure but that I remember there were some girls of the family
    who were part of the load. I know Worth thought so for later Ella and Worth were married.

    1771.

    His wife's father was Richard Ingram. Mr. Ingram's will dated Dec. 5 1780

    and it was probated Feb. Ct. 1781.

    Both of his daughter's, Zilpha and Elizabeth married Avera's
